Terms of service

These terms are the agreement between you and Yagni Corporation ("we", "us") for the use of spiffyk. By opening a room, joining one, or singing in one, you agree to them. If you don't, please don't use the service.
1. What spiffyk is
spiffyk is an online karaoke room. You open a room, share the link, and the people who join it can see and hear each other over a direct video connection between their browsers, queue songs, sing along to synchronised lyrics, and optionally record and share short clips of themselves.
Video and audio between singers travels peer-to-peer wherever the network allows it. Where it doesn't, it passes through a relay we operate. Either way we do not record it, and nothing is stored unless someone in the room deliberately records a clip.
2. Accounts, including the one you didn't ask for
You can sing without registering. Opening a room link creates an anonymous account for you automatically, with a generated stage name and no email address, so that scores, memberships and clips have somewhere to live. You can claim it later by registering, and everything carries over.
Anonymous accounts that never join a room are deleted after 24 hours. Anonymous accounts that joined rooms but never scored a song or shared a clip are deleted after 30 days. If you performed, or if you ever bought anything, your account is kept until you ask us to delete it.
You are responsible for what happens under your account, and for keeping your login details to yourself. Tell us at support@spif.fyi if you think someone else has them.
You must be 13 or older to use spiffyk, and old enough to agree to these terms where you live.
3. Room time, and what you're buying
spiffyk is metered in minutes of room time. The clock runs on a room while two or more people are in it, or while a song is playing. It is charged to the account that opened the room — guests never pay, and joining someone else's room never costs you anything.
Registered accounts can claim a free allowance each calendar month. Allowances are claimed, not accrued: an allowance you didn't claim in a month you weren't here was never created, and doesn't stack up. The size of the free allowance is a promotion and can change or end at any time, but minutes already on your clock stay yours.
Minutes bought in a pack do not expire. They are a licence to use the service, not currency: they have no cash value, cannot be transferred or sold, and cannot be exchanged for anything other than time on spiffyk. See the refund policy for how to get your money back.
When a room's clock reaches zero the music stops, but nothing else does — chat and video keep working, and the queue is still there when more time is added.
4. Payments
Payments are processed by Stripe. We never see or hold your card details; the payment form is Stripe's, on Stripe's servers. Prices are shown before you pay and include the amount you will be charged.
Minutes are added to your clock when Stripe confirms the payment, which is usually seconds and occasionally a little longer. If you have been charged and your clock hasn't moved after a few minutes, write to support@spif.fyi and we will sort it out.
5. What you may not do
Don't use spiffyk to:
- harass, threaten, defame or impersonate anyone;
- share sexual content involving minors, or any sexual content in a public room;
- share content that is unlawful, or that you have no right to share;
- upload or perform material you do not hold the rights to (see Copyright);
- break, overload, scrape or reverse-engineer the service, or evade its limits;
- resell access, or run it as a service for others, without our written agreement.
Rooms are hosted by the person who opened them. If you host a room, you are responsible for who you invite into it.
6. Clips and other things you share
You keep ownership of everything you record, upload or perform. By sharing a clip you give us permission to store it and show it to the people you shared it with — inside your room, or in the shared feed if you chose that — for as long as you leave it up. That permission ends when you delete it, other than for copies in ordinary backups.
Clips can be reported by anyone who can see them, and are hidden automatically once enough people report one. We may hide or delete anything that breaks these terms, and we don't have to explain a judgement call before making it.
A performance involves everyone in the room. Please don't record or share other people without asking them first — in many places it isn't just rude, it's illegal.
7. Ending it
You can stop using spiffyk whenever you like, and ask us to delete your account at privacy@spif.fyi.
We can suspend or close an account that breaks these terms. If we close yours for something you didn't do, or without cause, we will refund unused minutes you paid for. If we close it because of something you did, we won't.
8. The service comes as it is
spiffyk is provided as it is, without warranties of any kind. We don't promise it will be uninterrupted, that every connection will succeed, or that any particular song will be available. Video between browsers depends on networks we don't control, and some networks block it.
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
9. Changes
We may update these terms. If a change materially affects you we will say so in the app before it takes effect. Continuing to use spiffyk after that means you accept the new version. The effective date is at the top of this page.
10. Law, and getting hold of us
These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules. If you live somewhere with consumer protections that can't be contracted away, you keep them.
